Reflecting on the role of the ANS as a protector of public interest

Resumo: This paper discusses the possibility of public interest - as a normative precept of the ANS (the Brazilian agency that regulates the private healthcare market) - serving as a guideline for a program led by the ANS that would reform healthcare companies. For such a program to be carried out, the pragmatism evident in the management of the regulatory agency would need to be overcome and the regulatory model would have to be altered by improving the part of the constitutional guidelines which state that health care can be provided by the private sector. This new institutional framework would provide the basis for a regulatory social contract which could simultaneously deal with the specific application of the right to access to health care on the market and the prospect of a single SUS (Brazilian National Health System).

A realização desse programa pressupõe, entretanto, a superação do pragmatismo presente na gestão da agência reguladora, bem como a mudança do modelo regulatório mediante o aperfeiçoamento das diretrizes constitucionais, naquilo onde se lê que a assistência à saúde é livre à iniciativa privada.
