Resumo: | The article is focused on social rights, starting from the course taken by the emergence of citizenship in modem societies, and the consequent duty imposed on the State to guarantes the enforcement of such rights. Consistently, with this view, the author analyses the re-establishment of the citizen's consciousness as a factor absolutely necessary to the democratic transition now undergone by Brazilian society, since in the framework of foregoing regimes there has been a systematic denial of citizenship as a set of civil, politica1 and social rights. Two distinct patterns of development of social rights in modem States – both within liberal and authoritarian capitalism - are also studied, being appraised the present 'limitations presenting the complete recognition of citizenship in modern society. The article concludes with a study of the evolution of social rights in Brazil, analysing the country's Constitutions and institutional practices. This discussion purports an examination of needs and possibilities of a reversal in the present situation, as part of the consolidation of the Brazilian democratical process. |
