The legal professionals' culture facing the reality show: justice from an unofficial perspective

Resumo: This article analyzes how the legal professionals¿ culture is mobilized when judges, lawyers and attorneys evaluate justice issues presented in popular television programs such as reality shows. The literature on legal sociology and media sociology points out a permanent tension between media and justice, due to outstanding antagonistic features such as media informality and judicial procedure formality. This would be particularly visible in the reality show, in which the ordinary citizens¿ word is more valued than that of the professionals. Therefore, this study chose Programa do Ratinho, which is one of the most polemic Brazilian television shows. The discussion about the confrontation between media and justice is connected to the issue of public management, because the media acts as society¿s watchdog, pressing state officials and the institutional apparatus to work according to the principles of justice, which are not always enforced by the legal system.

A literatura especializada em sociologia do direito e sociologia da mídia aponta uma permanente tensão entre os dois campos, por causa de antagonismos marcantes como a informalidade dos meios de comunicação e a formalidade do procedimento jurídico. Essa tensão seria particularmente visível no reality show, pela sua característica de privilegiar a palavra do cidadão comum em detrimento da palavra dos especialistas. Foi por essa razão que se escolheu como locus de investigação o Programa do Ratinho, um dos mais polêmicos programas do gênero na TV brasileira.
