Neoliberalism and Criminal Policy in Brazil After 1988: between re-democratization and de-democratization

Resumo: This article seeks to analyze key points of the criminal policy carried out by the Brazilian Federal Government in the decade following the enactment of the 1988 Constitution, to study the possible relations between such policies and the process of neoliberal transition occurred in the country during this period. In this way, it seeks to contribute with the discussion regarding the tensions between the aspirations of the implementation of the rights provided in the Constitution’s text and the excluding reality of neoliberal reforms. Based both on Marxist and Foucauldian readings of neoliberalism, the article points out that there was an “active redefinition” (Dagnino, 2004) of concepts like “citizenship” and “human rights” and that these concepts were used by the government to enable the strengthening of repressive measures. Based on that, the article also seeks to contribute with the debate regarding the “de-democratization” (Brown, 2015) process triggered by the spread of a neoliberal reason throughout different social spheres, and the debate regarding the convergences between neoliberalism and the strengthening of punishment and social control mechanisms.

En ese sentido, pretende contribuir al análisis de la tensión entre las pretensiones de realización de derechos previstas en el texto constitucional y la realidad excluyente de los ajustes neoliberales. A partir de una lectura cruzada de los aportes marxistas y foucaultianos al concepto de neoliberalismo, se señala cómo fue posible verificar en el período una "resignificación activa" (Dagnino, 2004) de nociones como "ciudadanía" y "derechos humanos", que comenzaron a ser utilizadas, a nivel gubernamental, como justificaciones para el aumento de la represión en el país. A partir de eso, buscamos contribuir al debate sobre los procesos de “desdemocratización” (Brown, 2015) desencadenados por la extensión de una racionalidad neoliberal a las diferentes esferas del tejido social, así como también a los debates sobre la convergencia entre el neoliberalismo y el endurecimiento de los mecanismos de castigo y control social.O artigo propõe uma análise de alguns pontos relevantes da política criminal implementada pelo governo federal brasileiro no decênio seguinte à promulgação da Constituição de 1988, com o objetivo de investigar possíveis relações de tais políticas com o processo de transição neoliberal verificado no país ao longo do período em questão. Nesse sentido, pretende-se contribuir com as análises sobre a tensão entre as pretensões de efetivação de direitos previstos no texto constitucional e a realidade excludente dos ajustes neoliberais. Em linhas gerais, partindo de uma leitura cruzada de aportes marxistas e foucaultianos ao conceito de neoliberalismo, pôde-se verificar no período uma “ressignificação ativa” (Dagnino, 2004) de noções como “cidadania” e “direitos humanos”, que passaram a ser utilizados, no plano governamental, como justificativas para o incremento da repressão no país.
