Resumo: This paper has focused on the normative regulation of lobbying under the purview of the Brazilian legislative process. Through theoretical analysis in the specialized doctrine and literature, it sought to identify the orientational pillars both in favor and against the regulation of the activity. Founded upon those rhetorics, the objective of this paper is to meditate on the impelling purposes of the regulatory activity in a democratic context. On a second step, this reflection has sought to verify the recommended and adopted mechanisms, in distinct engagements and circumstances, on behalf of a successful regulation of lobbying. The verification of the elementary mechanisms for the regulation derived, firstly, from the analytical study of previous efforts by three distinct institutions: the first one being the (i) Organization for Economic Cooperation and Development (OECD); the second being (ii) Transparency International Brazil; and finally reaching the theoretical application elaborated by (iii) The Center for Public Integrity (CPI). Building upon the knowledge and patterns recognized in the verification of regulatory mechanisms, the analysis focused, on a posterior moment, in the examination of the regulations in practice in three different countries, with diversified regulatory orientations. More specifically, the United States of America, which, as we will see further on, has implemented Lobby in a highly regulated manner; Canada, which adopted an intermediate level regulation; and, finally, Germany, which opted for a minimally regulated model. Subsequently, after having reflected critically on the notions and elucidations reached throughout this study, we sought to answer whether the bills proposed by the Brazilian Congress thus far, for the regulation of lobbying activity, have managed to meet the minimum efficacy threshold established by the doctrine for the regulation of the activity

Buscou-se, por meio de análises teóricas da doutrina e literatura especializadas, identificar os fundamentos basilares de orientações tanto favoráveis quanto desfavoráveis à regulação da atividade, para, alicerçado nessas retóricas, meditar acerca das razões motrizes dessa atividade regulatória em um contexto democrático. Identificados os aspectos referidos acima, a reflexão pretendeu, no segundo momento, verificar os mecanismos recomendados e adotados, em empenhos e circunstâncias distintas, em prol de uma implementação exitosa da regulação à atividade dos grupos de pressão. O esforço travado na verificação dos mecanismos elementares à regulação derivou, primeiramente, do estudo analítico comparado de esforços anteriores no âmbito de três instituições distintas: a primeira delas sendo a (i) Organização para a Cooperação e Desenvolvimento Econômico (OCDE); partindo na oportunidade seguinte para (ii) a Transparência Internacional do Brasil e; por fim, alcançando a reconhecida aplicação teórica elaborada pelo (iii) The Center for Public Integrity (CPI). Em um momento posterior, respaldando-se nas informações e padrões reconhecidos na observação dos mecanismos regulatórios verificados no capítulo anterior, a análise voltou-se ao exame comparado de regulações vigentes em três países, com orientações regulatórias diversas, são eles: os Estados Unidos, que, conforme veremos mais adiante, implementou o lobby de maneira altamente regulada; o Canadá, preferindo o acolhimento da regulação em grau intermediário e, por fim, a Alemanha, que fez a opção por um modelo minimamente regulado. Na sequência, após refletirmos criticamente acerca das noções e elucidações alcançadas ao longo do presente estudo, os projetos de regulamentação do lobby no Brasil, desde o ano de 1984 - quando se verificou a primeira proposição legislativa nacional de regulação desta atividade - serão analisados sob uma perspectiva comparada, pavimentando o caminho para a compreensão acerca dos parâmetros estimados pelos parlamentares para a regulamentação da atividade e os gargalos que intentam sanar por meio desta, para, por fim, verificar se as propostas apresentadas até o presente momento no âmbito do Congresso Nacional observam os mecanismos estabelecidos como elementares para a regulamentação efetiva da atividade, contando com o potencial de atingirem o fim a que se propõem.O presente trabalho description This paper has focused on the normative regulation of lobbying under the purview of the Brazilian legislative process. Through theoretical analysis in the specialized doctrine and literature, it sought to identify the orientational pillars both in favor and against the regulation of the activity. Founded upon those rhetorics, the objective of this paper is to meditate on the impelling purposes of the regulatory activity in a democratic context. On a second step, this reflection has sought to verify the recommended and adopted mechanisms, in distinct engagements and circumstances, on behalf of a successful regulation of lobbying. The verification of the elementary mechanisms for the regulation derived, firstly, from the analytical study of previous efforts by three distinct institutions: the first one being the (i) Organization for Economic Cooperation and Development (OECD); the second being (ii) Transparency International Brazil; and finally reaching the theoretical application elaborated by (iii) The Center for Public Integrity (CPI). Building upon the knowledge and patterns recognized in the verification of regulatory mechanisms, the analysis focused, on a posterior moment, in the examination of the regulations in practice in three different countries, with diversified regulatory orientations. More specifically, the United States of America, which, as we will see further on, has implemented Lobby in a highly regulated manner; Canada, which adopted an intermediate level regulation; and, finally, Germany, which opted for a minimally regulated model. Subsequently, after having reflected critically on the notions and elucidations reached throughout this study, we sought to answer whether the bills proposed by the Brazilian Congress thus far, for the regulation of lobbying activity, have managed to meet the minimum efficacy threshold established by the doctrine for the regulation of the activity
