The COVID-19 pandemic as a justification for discriminatory actions: : racial bias in the selectivity of the right to a companion during childbirth

Resumo: This article aims to analyze an unexpected by-product found in the master’s dissertation research entitledThe color of obstetric violence. Among the data collected in the interviews, it was noteworthy that 86% of white women could have a companion of their own choice at some point during hospitalization for childbirth. Among the black women interviewed, only 33% were authorized to exercise this same right guaranteed by Law No. 11,108 of 2005. The justification used by the health services for women who were denied the right to a companion was the implementation of control and prevention protocols in regarding the COVID-19 pandemic. In maternity hospitals where these pregnant women were hospitalized for childbirth, there was no unrestricted prohibition on the presence of a companion during hospitalization.Institutions analyzed case by case. This subjective evaluation, without defined criteria, showed a racial bias in selectivity. These violations of the rights of parturient women can be characterized as obstetric racism.

Entre los datos recogidos en las entrevistas llamó la atención que el 86% de las mujeres blancas pudieran tener un acompañante de libre elección en algún momento de la hospitalización por parto. Entre las mujeres negras entrevistadas sólo el 33% obtuvo la autorización para ejercer este mismo derecho garantizado por la Ley brasileña nº 11.108 de 2005. La justificación utilizada por los servicios sanitarios para las mujeres a las que se les negó el derecho de compañía fue la aplicación de protocolos de control y prevención en relación con la pandemia de COVID-19.  En los hospitales de maternidad en los que estas mujeres embarazadas fueron ingresadas para dar a luz no se prohibió sin restricciones la presencia de un acompañante durante la hospitalización. Las instituciones analizaron caso por caso. Esta evaluación subjetiva sin criterios definidos presentaba un sesgo racial en la selectividad. Estas violaciones de los derechos de las parturientas pueden caracterizarse como una modalidad de violencia obstétrica, el racismo obstétrico.Este artigo tem como objetivo analisar um subproduto inesperado encontrado na pesquisa de dissertação de mestrado intitulada A cor da violência obstétrica. Chamou a atenção dentre os dados levantados nas entrevistas que 86% das mulheres brancas puderam ter acompanhante de livre escolha em algum momento da internação para o parto. Entre as negras entrevistadas, somente 33% obtiveram autorização para exercer este mesmo direito garantido pela lei nº 11.108 de 2005. A justificativa utilizada pelos serviços de saúde para as mulheres que tiveram o direito a acompanhante negado foi a implementação de protocolos de controle e prevenção em relação à pandemia de Covid-19. Nas maternidades em que estas gestantes se internaram para o parto, não houve proibição irrestrita da presença de acompanhante durante a hospitalização. As instituições analisavam caso a caso. Esta avaliação subjetiva, sem critérios definidos, apresentou um viés racial na seletividade.
