Theme 793 of the Brazilian Federal Supreme Court: an analysis of gaps and contradictions

Resumo: | Objective: to demonstrate that Theme 793 of the Brazilian Supreme Court did not pacify public health jurisprudence, but even created new contradictory interpretations due to gaps and contradictions in its text. Methods: this work used the inductive method to explain what caused the sentences of the same Public Health Court, handed down by different judges, but using the Brazilian Supreme Court’s Theme 793 as rationale, to provide different solutions to the same problem. Results: the article highlights the main topics that are subject of jurisprudential divergences in the application of Theme 793 of the Brazilian Supreme Court and connects them to the gaps and contradictions of the Theme. Conclusion: the Brazilian Supreme Court’s Theme 793 gives rise to jurisprudential inconsistencies that cause legal uncertainty and harm the judiciary and public funds. Resultados: el artículo destaca los principales temas que son objeto de divergencias jurisprudenciales en la aplicación del Tema 793 de la Corte Suprema de Brasil, correlacionándolos con las lagunas y contradicciones del Tema. Conclusión: el Tema 793 de la Corte Suprema de Brasil da lugar a diferencias jurisprudenciales, provocando inseguridad jurídica y perjuicio a la jurisdicción ya las arcas públicas. Recepción: 20/10/22 | Aceptación: 03/04/23Objetivo: demonstrar que o Tema 793 do Supremo Tribunal Federal (STF) não pacificou a jurisprudência em matéria de saúde pública e ainda criou interpretações destoantes por possuir lacunas e contradições em sua redação. Metodologia: a pesquisa utilizou o método indutivo para compreender o que levou sentenças de uma mesma Vara de Saúde Pública, proferidas por magistrados diferentes, mas utilizando como fundamento o Tema 793 do STF, a dar soluções diferentes a problemas semelhantes. Resultados: o princípio da solidariedade; as regras de repartição de competência; o problema da composição do polo passivo em ações de saúde; a condenação em honorários advocatícios de sucumbência; a composição do polo passivo em demandas sobre tecnologia não incorporada ao SUS; e o conflito de competência entre Justiça Federal e Estadual são tópicos alvos de divergências jurisprudenciais na aplicação do Tema 793 do STF e que estão relacionados às lacunas e contradições do Tema. Conclusão: o Tema 793 do STF dá azo a divergências jurisprudenciais, causando insegurança jurídica e prejuízo ao jurisdicionado e aos cofres públicos.
