Resumo: The essay aims to reflect on the contradictions experienced by human rights from Modernity, in a historical perspective. It addresses the complexity of rights discourse - from the first to the fourth generation - and the crisis of the Social Rule of Law. The conclusion is that it is difficult to interpret and apply the core content of human rights, including aspects related to the right to health, given the current historical moment.

En este contexto, aborda la complejidad del discurso de los derechos, desde la primera hasta la cuarta generación, y la crisis del Estado de Derecho Social, concluyendo por la dificultad de interpretar y aplicar el contenido central de los derechos humanos, incluidos los aspectos relacionados con el derecho a la salud, dado el momento histórico actual.O ensaio tem como objetivo refletir acerca das contradições vivenciadas pelos direitos humanos, sob uma perspectiva histórica, a partir da Modernidade.
