Resumo: This study aimed to survey the legislation about stem cell therapies at the national and international levels. We also discuss the regulatory aspects adopted for stem cell therapies in Brazil. We conclude that one must be cautious when developing a national legislation. Regulatory studies should be conducted so that this legislation does not hinder clinical research and is not fragmented, as seen in other countries. Periodic reviews of regulations that will not prevent the progress of science and ensure the safety of the population should be performed.

Buscou-se também discutir a abordagem de tratamento que poderá ser adotada para a regulamentação das terapias celulares no Brasil. Com base neste levantamento, concluímos que se deve ter cautela na elaboração da regulamentação nacional. Devem ser realizados estudos regulatórios para que esta legislação não se torne um obstáculo para as pesquisas clínicas e não seja fragmentada como em outros países.
