RESUMO O trabalho traça o perfil do contrato de arrendamento rural, a partir da análise do Estatuto da Terra e da legislação correlata, bem como de algumas decisões selecionadas sobre o tema lavradas pelo Superior Tribunal de Justiça. O estudo apresenta uma visão contemporânea do arrendamento rural, explicando sua inserção no Estatuto da Terra, como instrumento de fomento à ocupação do solo, a possibilitar seu uso por não proprietários, evitando a ociosidade da terra. Será demonstrada a clara e importante interferência do Estado nos negócios agrários, justificada à época da promulgação do Estatuto da Terra pela suposta fragilidade do trabalhador rural. Serão abordados temas controversos como direito de preferência, prazo contratual, forma da contraprestação, a indicar a ausência de alinhamento na interpretação dos contratos agrários. ABSTRACT The work traces the profile of rural lease, from the analysis of the Land Act and related legislation, as well as some selected on the theme drawn by the Supreme Court decisions. The study presents a contemporary vision of rural lease, explaining their inclusion in the Land Statute, as an instrument to promote `land occupation, to enable its use by non-owners, avoiding idle land. Will be demonstrated, a clear and important state interference in agribusinesses, justified at the time of enactment of the Statute of the earth by the supposed fragility of rural workers. Controversial issues will be addressed as preemptive rights, contractual term, form of consideration, indicating the lack of alignment in the interpretation of agrarian contracts.
