Os Reverberos do Projeto de Lei 8.045/2010 na Ressignificação do Tribunal do Júri / The Reverberts of Bill 8.045/2010 in the Resignification of the Jury Court

Este trabalho tem por objetivo analisar as mudanças propostas pelo Projeto de Lei 8.045/2010, que dispõe sobre o novo Código de Processo Penal brasileiro, ao procedimento especial do Tribunal do Júri, porquanto tal projeto busca instituir novas diretrizes ao procedimento do júri que, em princípio, podem tolher princípios constitucionais ligados ao Tribunal do Júri. Para tanto, foi empregado o método hipotético dedutivo, por meio do levantamento de hipóteses preliminares e, na sequência, seu falseamento para chegar-se a conclusões, ainda que provisórias. A técnica de pesquisa foi bibliográfica por meio da leitura de doutrina, legislação e jurisprudências que tratam da temática. Ao final, foi possível concluir que as mudanças legislativas previstas no Projeto de Lei 8.045/2010 são violadoras de princípios constitucionais da razoável duração do processo e do sigilo das votações no tribunal do júri, além de apresentarem diversos prejuízos às partes, em especial ao acusado, o mais vulnerável na relação processual. Palavras-chave: Tribunal do júri. Novo Código de Processo Penal. ABSTRACT This work aims to analyze the changes proposed by Bill 8.045/2010, which provides for the new Brazilian Code of Criminal Procedure, to the special procedure of the Jury Court, as such project seeks to establish new guidelines for the procedure of the jury that, in principle, may hinder constitutional principles linked to the Jury Court. For this purpose, the deductive hypothetical method was used, through the survey of preliminary hypotheses and, subsequently, their falsification to reach conclusions, even if provisional. The research technique was bibliographical through the reading of doctrine, legislation and jurisprudence that deal with the subject. In the end, it was possible to conclude that the legislative changes foreseen in the Bill 8.045/2010 violate the constitutional principles of the reasonable duration of the process and the secrecy of the votes in the jury court, in addition to presenting several damages to the parties, especially to the accused, the most vulnerable in the procedural relationship. Keywords: Jury Court.
