INITIAL STUDIES OF ARTIFICIAL INTELLIGENCE: ACCESSORY TOOL OR A NEW PROCEDURAL SUBJECT?

Resumo: The article aims to analyze whether artificial intelligence is able to adapt to the fundamental institutes of the process and, in this sense, it is necessary to examine the theoretical models of process and cognition, in order to assess whether this artificial intelligence is being placed in the service of the jurisdiction or if it is being assigned as a procedural subject. The issue involves the need to exercise fiscal control over algorithms and robotic decisions to effectively guarantee the due process of the Constitution. To that extent, it is necessary to ask who are the procedural subjects of jurisdictional decisions handed down robotically, thus considered as resulting from the crossing of atomized data and chosen by sampling, based on unclear criteria forming universalizing projections, in order to disregard the variables and particularities arising from specific situations that actually occurred.

El tema involucra la necesidad de ejercer control fiscal sobre algoritmos y decisiones robóticas para garantizar efectivamente el debido proceso constitucional. En ese sentido, es necesario preguntarse quiénes son los sujetos procesales de las decisiones jurisdiccionales dictadas robóticamente, consideradas así como resultado del cruce de datos atomizados y elegidos por muestreo, en base a criterios poco claros que forman proyecciones universalizadoras, para desconocer las variables. y particularidades derivadas de situaciones concretas que realmente ocurrieron.L'article vise à analyser si l'intelligence artificielle est capable de s'adapter aux instituts fondamentaux du processus et, en ce sens, il est nécessaire de procéder à un examen des modèles théoriques du processus et de la cognition, afin d'évaluer si cette intelligence artificielle le renseignement est mis au service de la juridiction ou s'il est attribué en tant qu'objet de procédure. La question implique la nécessité d'exercer une taxation sur les algorithmes et les décisions robotiques pour la garantie effective d'un processus constitutionnel régulier. Dans cette mesure, il faut s'interroger sur qui sont les sujets procéduraux des décisions juridictionnelles rendues de façon robotique, donc considérées comme résultant du croisement de données atomisées et choisies par sondage, à partir de critères non précisés qui forment des projections universalisantes, afin de faire abstraction des variables et particularités découlant des situations particulières qui se sont réellement produites.O presente artigo visa investigar se a inteligência artificial é capaz de se adaptar aos institutos fundamentais do processo constitucional. Sem pretender esgotar todas as questões relevantes que permeiam o tema da inteligência artificial, entende-se que é necessário questionar, inicialmente, se a inteligência artificial está sendo analisada como um novo sujeito do processo (um novo "juiz") ou se é uma ferramenta tecnológica. O marco teórico utilizado é o Processo Constitucional. A pesquisa bibliográfica baseia-se numa abordagem crítica-reflexiva quanto ao tema-problema.
