ELECTRONIC MONITORING OF PEOPLE: THOUGHTS ON THE ADVENT OF THE TECHNOLOGY AND ITS APPLICATION IN THE BRAZILIAN CONTEXT

Resumo: The research aims to analyze the advent of the technology of electronic monitoring of people and its application in the national context, sense in which raises the following problem: is the technology of electronic monitoring of people in penal sphere in Brazil a tool of extension of freedom or one of control enlargement on the monitored individuals? Therefore, as a preliminary hypothesis, it is  prospected that, despite the possibilities of more freedom presented by the device, in practice, the threshold of control that is established ends up overcoming them. In order to analyze this hypothesis, the article is divided into two sections: the first concerning about reflections on the advent of electronic monitoring of people and the second one focused on the study of its application in the Brazilian criminal context, being used methodological parameters of a hypothetical-deductive approach,followed by bibliographic, legislative and jurisprudential analyzes.

In order to analyze this hypothesis, the article is divided into two sections: the first concerning about reflections on the advent of electronic monitoring of people and the second one focused on the study of its application in the Brazilian criminal context, being used methodological parameters of a hypothetical-deductive approach,followed by bibliographic, legislative and jurisprudential analyzes.Nesta pesquisa foram delineadas considerações acerca da tecnologia de monitoração eletrônica de pessoas em esfera penal, tendo como problemática o paradoxo existente no Brasil, relativo ao fato de que, ao mesmo tempo em que a medida tem o condão de oferecer maior liberdade aos apenados, também é capaz de estabelecer mais elevado nível de controle. Nesse sentido, a hipótese inicial foi a de que, apesar das possibilidades de liberdade teoricamente dispostas em torno da monitoração eletrônica de pessoas, o limiar de controle que se estabelece, na prática, supera as prometidas vantagens do instituto. Objetivando, portanto, analisar a viabilidade da hipótese, estabeleceram-se duas seções para o artigo: a primeira, relativa aos aspectos iniciais da monitoração eletrônica de pessoas em âmbito penal, bem como às possibilidades que já aparecem no horizonte de futuro da medida; e a segunda, referente à realidade do dispositivo no Brasil, levando-se em consideração a manifesta oposição entre horizontes de liberdade e fronteiras de controle. Em termos metodológicos, utilizou-se abordagem hipotético-dedutiva e conduziram-se análises bibliográfica, legislativa e jurisprudencial. A título de considerações finais, depreendeu-se a confirmação da hipótese inicial.
