of the jurisdictional activity, from the institution of the Democratic State of Law, as a way of resignifying the process. From this analysis, it is demonstrated how this revisiting of the concept of process, made it essential for the realization of democracy, overcoming instrumentalism, as it is a mechanism of inclusion and counter-majoritarian popular participation, allowing for discussion on issues involving minorities, normally excluded from the decision-making procedures of the State, even more in the pandemic and precarious contemporaneity of society. For the present study, bibliographical research and the deductive method were used, starting from a macro perspective to a micro-analytical conception about the theme-problem under study and, finally, as a technical procedure the thematic, theoretical and interpretive, seeking a suggestion for the solution of the highlighted question.
