Resumo: This work aims to explore the impossibility of implementing the Parliamentary system in Brazil, from the Constitution of 1988 point of view, whichafter 30 years supporting the democracy of the nation, faces movements that seeks the reform of the presidential system, mainly in moments of political instability, diverging from what is foreseen in the Act of Transitional Constitutional Provisions. For the preparation of the work, it is necessary to analyze the section 2 of the ADCT, instituted by the Originating Constituent Power, and to understand why Brazil has adopted the Presidential System, in order to continue with legal and political analysis, through the methodology of bibliographic review and the approach method of hypothetical-deductive, in order to attest to the impossibility of implementing this system in our democracy.
