A SEXUAL AND REPRODUCTIVE HEALTH FOR WOMEN IN THE DIMENSION OF HUMAN RIGHTS:: TENSIONS AND AMBIGUITIES FOR SEARCHING FOR RECOGNITION

Resumo: The sexual and reproductive health of women is an issue that still surrounds countless debates in the most diverse spheres - both political and legal, especially with regard to its effectiveness and effectiveness in the recognition and protection of rights. In this sense, the present article aims to foster some reflections regarding the tensions and ambiguities involved in the issue of prediction and constitutional treatment given, in the field of public health, to the sexual and reproductive health of women, based on a dimension of dialogues with the human rights framework. Through a bibliographic study, following the hypothetical deductive method, the right to health will be analyzed in the Federal Constitution of 1988 and, subsequently, the sexual and reproductive rights of women in Brazil and the constitutional treatment given to the topic. Finally, it was found that promoting and enhancing legal mechanisms and public policies aimed at women's sexual and reproductive health in Brazil remains a major challenge.

Nesse sentido, o presente artigo tem como objetivo fomentar algumas reflexões no que tange às tensões e ambiguidades envolvidas na temática da previsão e tratamento constitucional dispensado, no campo da saúde pública, à saúde sexual e reprodutiva das mulheres, a partir de uma dimensão de diálogos constantes com o marco dos direitos humanos. Através de um estudo bibliográfico, seguindo o método hipotético dedutivo, primeiramente será analisado o direito à saúde na Constituição Federal de 1988 e, na sequência, os direitos sexuais e reprodutivos das mulheres no Brasil e o tratamento constitucional dispensado ao tema.
