Importance of Trademarks in Patent Protection: Natura's case

Resumo: | Worldwide, advantages and disadvantages of the implementation of currents trademark and patent systems are well known, both in their social and economic aspects. Trademarks and patents are Industrial Property (IP) assets and are used strategically in various types of markets, in order to optimize the appropriation of profits and recover the investments made. The strategy of combining these assets is well known and widespread in certain technological areas. In this sense, the present study seeks to identify the main strategies adopted by the Brazilian company Natura Cosméticos S.A., regarding the protection of trademarks and patents, observing their interrelations. In this work is applied a methodology that analyses the evolution of trademark and patent filings over the last four decades, aligned to information of investments made in the same period of time by the company. As a main result, was verified an increase in the IP protection levels over the last decades up to the present, as well as an increase in investment in innovation. Hence, it can be inferred that the use of association strategies between trademarks and patents, not only helps investment in innovation, but are also essential to ensure Natura company stands out in its segment. Patents.En el mundo, son bien conocidas las ventajas y desventajas de la implementación de los actuales sistemas de marcas y patentes, tanto en sus aspectos sociales como económicos. Las marcas y las patentes son activos de Propiedad Industrial (PI) y se utilizan estratégicamente en diversos tipos de mercados, con el fin de optimizar la apropiación de beneficios y recuperar las inversiones realizadas. La estrategia de combinar estos activos es bien conocida y extendida en determinadas áreas tecnológicas. En este sentido, el presente estudio busca identificar las principales estrategias adoptadas por la empresa brasileña Natura Cosméticos S.A., en cuanto a la protección de marcas y patentes, observando sus interrelaciones. En este trabajo se aplica una metodología que analiza la evolución de las solicitudes de registro de marcas y patentes en las últimas cuatro décadas, alineada con información de inversiones realizadas en el mismo período de tiempo por la empresa. Como principal resultado se verificó un aumento en los niveles de protección de la PI en las últimas décadas hasta la actualidad, así como un incremento en la inversión en innovación. Por lo tanto, puede inferirse que el uso de estrategias de asociación entre marcas y patentes, no sólo ayuda a la inversión en innovación, sino que también son esenciales para que la empresa Natura se destaque en su segmento. Patentes.No mundo, as vantagens e desvantagens da implementação dos sistemas marcário e patentário vigentes são bastante conhecidas, tanto em seus aspectos sociais quanto econômicos. A Marca e a Patente são ativos de Propriedade Industrial (PI) e são utilizados estrategicamente nos mais variados tipos de mercado, de maneira a otimizar a apropriação dos lucros e recuperar os investimentos empregados. A estratégia de combinação destes ativos é bastante conhecida e difundida em determinadas áreas tecnológicas. Neste sentido, o presente estudo busca identificar as principais estratégias adotadas pela empresa brasileira Natura Cosméticos S.A., no tocante à proteção de marcas e patentes, observando suas inter-relações. Aplica-se aqui uma metodologia que analisa a evolução dos depósitos de marcas e patentes nas últimas quatro décadas, alinhada às informações de investimentos realizados no mesmo interstício temporal pela empresa. Como principal resultado, verificou-se uma crescente na mudança de patamares de proteção de PI ao longo das últimas décadas até os dias atuais, assim como um crescente investimento em inovação. Disto, infere-se que a utilização das estratégias de associação entre marcas e patentes, não apenas auxilia no investimento em inovação, como também são essenciais para garantir o destaque da empresa Natura em seu segmento de atuação.
