Resumo: This article discusses the social function of the contract and aims to analyze if the effectiveness of such principle in the 2002 Brazilian Civil Code, as a rule that is open, represents an attempt of the State to assure citizens of their fundamental rights as the human dignity, or so, it represents a way of State intervention on private relations.
