Resumo: The transformation of the theory of contracts resulted in the publication of new principles, to balance and harmony in the relationship, through the observance of principles such as objective good faith and the social function of contracts, guided in human dignity and state interventionism. This study examines the social function of contracts, intented on personality´s rights, addressing juridical nature and basis, its main characteristics and supposed restriction on the principle of freedom contract.
