HUMAN RIGHTS EDUCATION AND THE DCNs: the potential of clinical legal pedagogy

Resumo: | This article aims to defend the clinical human rights education (HRE) as a theory and a strategic pedagogical practice for the development of personal, relational and professional skills today. These abilities for legal professionals are foreseen in the new National Curricular Guidelines (DCN) for Law courses in Brazil, approved in december 2018 by the Ministry of Education. The Brazilian State, since 2003, has been establishing teaching-learning policies on human rights, starting with the creation of the National Committee for Human Rights Education, which was responsible for drafting the main national public policy on the subject: the National Plan for Human Rights Education (PNEDH). This Plan has a specific axis for University Education and another one for the Education of Law professionals. Firstly, this paper will present a brief trajectory of the HRE policy in the country and then how this policy has influenced and influences Brazilian Law courses. Thereafter, will be discussed which specific competences and skills, foreseen in the new DCN's of Law, are related to transversal themes of human rights, such as racial ethnic, gender and diversity. Finally, the results of an assessment conducted with students at the human rights legal clinic at the Law School of the University of Joinville (Univille) will be described, in order to demonstrate how Law students perceive the potential of clinical pedagogy for the development of competences and skills in legal careers. |

Estas habilidades para los profesionales del derecho están previstas en las nuevas Directrices Curriculares Nacionales para los cursos de Derecho en Brasil (DCN), aprobadas en Diciembre de 2018 por el Ministerio de Educación. El Estado Brasileño, desde 2003, viene estableciendo políticas de enseñanza-aprendizaje en derechos humanos, con la creación del Comité Nacional de Educación en Derechos Humanos, que fue responsable de la elaboración de la principal política pública nacional en la materia: el Plan Nacional de Educación en Derechos Humanos (PNEDH). Este Plan EDH tiene un eje específico para la Educación Superior y otro, específico para la formación de los profesionales del Derecho. Primero, este trabajo presentará una breve trayectoria sobre la política de EDH en el país y luego cómo esta política ha influido e influye en los cursos de Derecho brasileños. Luego, discutiremos qué capacidades y habilidades específicas, previstas en las nuevas DCNs están relacionadas con cuestiones transversales de derechos humanos, como cuestiones étnicas, raciales, de género y de diversidad. Finalmente, se describirán los resultados de una evaluación realizada con estudiantes de la clínica jurídica de derechos humanos de la carrera de Derecho de la Universidad de la Región de Joinville (Univille), con el fin de demostrar cómo estudiantes de Derecho perciben el potencial de la pedagogía clínica para el desarrollo de capacidades y habilidades en carreras legales.Este artigo visa defender a educação clínica em direitos humanos (EDH) como uma teoria e prática pedagógica estratégica para o desenvolvimento de competências pessoais, relacionais e profissionais. Essas habilidades para profissionais da área jurídica estão previstas nas novas Diretrizes Curriculares Nacionais (DCNs) para os cursos de Direito no Brasil, aprovadas em dezembro de 2018 pelo Ministério da Educação. O Estado brasileiro, desde 2003, vem estabelecendo políticas de ensino-aprendizagem sobre direitos humanos, por meio da criação do Comitê Nacional de Educação em Direitos Humanos, que foi responsável pela elaboração da principal política pública nacional no tema: o Plano Nacional de Educação em Direitos Humanos (PNEDH). O PNEDH possui um eixo específico destinado ao ensino superior e ainda outro, específico para o ensino de profissionais da área do Direito. Primeiramente, este trabalho apresenta uma breve trajetória sobre a política de EDH no país e em seguida como essa política influenciou e influencia os cursos brasileiros de Direito. Depois, debate quais competências e habilidades específicas, previstas nas novas DCNs do Direito, se relacionam com temáticas transversais de direitos humanos, como temas étnico-raciais, de gênero e diversidades.
