UMA ANÁLISE SOBRE O BENEFÍCIO ASSISTENCIAL À PESSOA DEFICIENTE À LUZ DA CONSTITUIÇÃO FEDERAL

O presente trabalho consiste na análise do benefício assistencial à pessoa com deficiência à luz da Constituição Federal, benefício este com previsão na Carta Magna e com regulamentação disciplinada pela Lei nº 8.742/93. Justifica-se a relevância do estudo em tela pelo fato de o benefício assistencial configurar-se como a materialização de uma política social que prevê o atendimento das necessidades básicas da pessoa com deficiência, incapaz de prover, seja por si ou por meio de sua família, a sua mantença. Constituem-se como objetivo principal a verificação da aplicação de princípios constitucionais em decisões judiciais e a análise sobre a sua importância como sustentação na aferição dos requisitos da concessão do benefício assistencial ao deficiente. A constar, os princípios constitucionais objeto de pesquisa são os seguintes: princípio da dignidade da pessoa humana, princípio da solidariedade e princípio da isonomia. Exsurge a conclusão de que a análise para fins de benefício de prestação continuada à pessoa com deficiência precisa, necessariamente, considerar em seu contexto, bem como assentar-se nos princípios constitucionais referidos anteriormente, a fim de alcançar os objetivos colimados pela Constituição e garantir, assim, efetividade aos preceitos constitucionais fundantes do segmento da Assistência Social.Palavras-chave: Assistência social. Princípios constitucionais.ABSTRACTThis essay consists of the analysis of the social benefit to the disabled person according to the Federal Constitution, a benefit that is mentioned in the Brazilian Constitution and regulated by Law 8.742/93. The relevance of this study is justified by the fact that the social benefit is configured as the materialization of a social policy that provides the basic needs of the disabled people, unable to provide, either by themselves or through their family, their own maintenance. The main objective is to verify the application of constitutional principles in judicial decisions and the analysis of their importance as a basis in the assessment of the requirements to grant the benefit to the disabled people. The constitutional principles under investigation are the following: principle of the dignity of the human person, principle of solidarity and principle of isonomy. It is possible to conclude that the analysis of continuing benefit to the disabled person necessarily needs to be considered in its context, as well as to be based on the referred constitutional principles, in order to achieve the objectives presented by the Constitution and, thus, guarantee effectiveness to the founding constitutional precepts of the Social Assistance segment.Keywords: Social assistance.
