Resumo:   O artigo, antes de tudo define o conceito de ‘Testamento Vital’, considerado como documento que dispõe sobre cuidados e tratamentos com um paciente com uma doença terminal. Em seguida trata das normas, a respeito do testamento vital ditadas pelo CFM e à sua formalidade aprovada Conselho Nacional de Justiça. Sucessivamente passa para um estudo comparado, considerando o posicionamento de diversos países do mundo sobre tal temática. E, por fim, procura aplicar tal problemática na atual situação do Brasil em tempos de pandemia de COVID-19, em consonância com o princípio da dignidade da pessoa humana. A pesquisa se caracteriza como bibliográfica e documental.

A pesquisa se caracteriza como bibliográfica e documental.  The article, in the first moment, defines the concept of the ‘Vital Testament’, considered a document that provides care and treatment for a terminally ill patient. Then, it exposes the rules by which the CFM dictates the strong will and its formality approved by the National Council of Justice. Then, it moves on to a comparative study, considering the position of several countries’ work on this theme. Finally, it seeks to apply this problem in the current situation in Brazil in times of the COVID-19 pandemic, in line with the principle of human dignity.
