Historical Frameworks and Legal Devices for the Inclusion of Elderly People in a Society in Transformation

Resumo: We present a survey of the historical and legal milestones regarding population aging to analyze how the rights of the elderly are being guaranteed in Brazilian society. We used documental research as a methodological criterion on official websites of international institutions: United Nations, Pan-American Health Organization and national: Presidency of the Republic of Brazil, Federal Senate, Ministry of Health, Ministry of Social Security and Assistance, Brazilian Institute of Geography and Statistics, as well as the analysis of data from scientific bases. Research in scientific bases was conducted through search strings using the words: public policies, health, education, citizenship, and and and or operators. With the results, we found that although our society has significant legal instrumentalization in favor of the rights of the elderly, it is, however, necessary more participation and social control so that the legal conquests are carried out, since the existing public policies to guarantee the fulfillment of the rights already conquered proved to be still insufficient. Meta searchPresentamos un levantamiento de los hitos históricos y jurídicos sobre el envejecimiento de la población con el fin de analizar cómo los derechos de las personas mayores están siendo garantizados en la sociedad brasileña. Utilizamos como criterio metodológico la investigación documental en sitios web oficiales de instituciones internacionales: Naciones Unidas, Organización Panamericana de la Salud y nacionales: Presidencia de la República de Brasil, Senado Federal, Ministerio de Salud, Ministerio de Previsión y Asistencia Social, Instituto Brasileño de Geografía y Estadística, así como el análisis de datos de bases científicas. La investigación en bases científicas se realizó a través de cadenas de búsqueda utilizando las palabras: políticas públicas, salud, educación, ciudadanía y y operadores u. Con los resultados, encontramos que si bien nuestra sociedad cuenta con una importante instrumentación jurídica, basada en tratados internacionales, a favor de los derechos de las personas mayores, sin embargo, es necesaria una mayor participación y control social para que los logros jurídicos se lleven a cabo. , ya que las políticas públicas existentes para garantizar el cumplimiento de los derechos ya conquistados resultaron aún insuficientes.Apresentamos um levantamento dos marcos históricos e legais acerca do envelhecimento populacional a fim de analisarmos como estão sendo garantidos os direitos da pessoa idosa na sociedade brasileira. Utilizamos como critério metodológico a pesquisa documental em sites oficiais de instituições internacionais: Organização das Nações Unidas, Organização Pan-americana de Saúde e nacionais: Presidência da República do Brasil, Senado Federal, Ministério da Saúde, Ministério da Previdência e Assistência social, Instituto Brasileiro de Geografia e Estatística, bem como a análise de dados oriundos de bases científicas. A pesquisa nas bases científicas foi realizada por meio de strings de busca utilizando as palavras: políticas públicas, saúde, educação, cidadania, os operadores and e or. Com os resultados, constatamos que apesar de nossa sociedade dispor de significativa instrumentalização legal, com base em tratados internacionais, em prol dos direitos das pessoas idosas, faz-se, no entanto, necessária  mais participação e controle social para que as conquistas legais sejam efetivadas, visto que as políticas públicas existentes para garantir o cumprimento dos direitos já conquistados mostraram-se ainda insuficientes.  Palavras-chave: Políticas públicas.
