The semantic void in the operationality of opinio delicti: a study based on the Kiss case

Resumo: The present article scrutinizes how the semantic void, in the operationality of the opinio delicti, was decisive in establishing the legal-dogmatic contours of the Kiss Case. Thus, this article intends to solve the following question: what interpretation criteria were adopted by the Public Prosecutor's Office in preparing the complaint? The research method is the hermeneutic phenomenological. In conclusion, it was found that the opinion about the crime does not follow regular criteria for its formulation and, for this reason, can legitimize the practice of excessive accusation, especially in crimes that deal with the doubt regarding the subjective elements of the type.

Así, este artículo pretende resolver la siguiente interrogante: ¿qué criterios de interpretación adoptó el Ministerio Público en la preparación de la denuncia? El método de investigación es el fenomenológico hermenéutico. En conclusión, se encontró que la opinión sobre el delito no sigue criterios regulares para su formulación y, por ello, puede legitimar la práctica de acusación excesiva, especialmente en delitos que versan sobre la duda sobre los elementos subjetivos del tipo.O presente artigo perscruta como o vazio semântico, na operacionalidade da opinio delicti, foi determinante para fixar os contornos jurídico-dogmáticos do Caso Kiss. Assim, este artigo pretende solucionar o seguinte questionamento: quais critérios de interpretação foram adotados pelo Ministério Público na elaboração da denúncia? O método de pesquisa é o fenomenológico hermenêutico.
