Resumo: This article intends to study the abortion of anencephalic fetuses discussed in ADPF 54. For this, medical concepts and the legal arguments used in the discussion of the aforementioned Allegation of Non-compliance with a Fundamental Precept judged by the Supreme Court in 2008 are analyzed. deductive approach, the methods of monographic procedure and the techniques of documentary and bibliographic research, the position of that Judicial Court regarding several fundamental rights related to the matter, such as the right to life defended by religious entities and the autonomy of the will of the mother, with references to the right to health and dignity of the pregnant woman.

Para ello, se analizan conceptos médicos y argumentos jurídicos utilizados en la discusión de ADPF juzgada por el Tribunal Supremo en 2008. A partir de la metodología del enfoque deductivo, los métodos de procedimiento monográfico y las técnicas de investigación documental y bibliográfica, la posición de dicho Tribunal sobre diversos derechos fundamentales relacionados con la materia, como el derecho a la vida defendido por las entidades religiosas y la autonomía de voluntad de la madre, con referencias al derecho a la salud y dignidad de la gestante.O presente artigo pretende estudar o aborto de fetos anencéfalos debatido na ADPF 54. Para isso, são analisados conceitos médicos e a argumentação jurídica utilizada na discussão da referida Arguição de Descumprimento de Preceito Fundamental julgada pelo Supremo Tribunal Federal em 2008.
