The liberal state and aid to the population in times of pandemic

Resumo: This article seeks to examine the role of the Liberal State during periods of emergency, especially in the face of the pandemic crisis of covid-19, a disease caused by the coronavirus, or, specifically, by SARS-CoV-2.In this context, the analysis permeates several currents of liberal thought, from libertarian authors who, in the philosophical line of Murray N. Rothbard, claim that state power is unproductive and immoral, to classics who understand the State as an essential entity for the protection of life, of freedom and property, like Frédéric Bastiat, reaching more modern liberal scholars, such as Ludwig von Mises, Friedrich Hayek and Milton Friedman, who, despite differing in relation to the intensity and mode of state intervention, develop their studies with a focus on in the indispensability of the State in relation to the institutional purposes for which it was created. In a second moment, according to the lessons of Stephen Holmes and Cass Sunstein, there is a need for public funding, through taxation, for the Liberal Fiscal State to act in order to guarantee rights of a liberal nature, even if these, paradoxically, whether what part of the doctrine treats as rights that require the state's duty of abstention. At the end, the possibilities of action of this model of State in pandemic periods are investigated, concluding that the State has fundamental relevance for the social and economic confrontation of the crisis established from the global spread of covid-19. The methodology uses bibliographic research, with consultations to books, national and foreign scientific articles and electronic sites specialized in legal, economic and political matters.

En dicho contexto, el análisis atraviesa distintas corrientes del pensamiento liberal, desde autores libertarios que, en la línea filosófica de Murray N. Rothbard, afirman ser el poder estatal improductivo e inmoral, hasta clásicos que entienden el Estado como ente esencial para la protección de la vida, de la libertad y de la propiedad, como Frédéric Bastiat, llegando a estudiosos liberales más modernos, como Ludwig von Mises, Friedrich Hayek y Milton Friedman, que, aún divergiendo con relación a la intensidad y al modo de la intervención estatal, desarrollan sus estudios enfocados en la indispensabilidad del Estado con relación a los fines institucionales por los cuales fue creado. En un segundo momento, según las enseñanzas de Stephen Holmes y Cass Sunstein, se observa la necesidad de financiamiento público, por intermedio de la tributación, para que el Estado Fiscal Liberal actúe a fin de garantizar los derechos de carácter liberal, aunque estos, paradójicamente, sean lo que parte de la doctrina trata como derechos que exigen el deber de abstención estatal. Al final, se investigan las posibilidades de actuación de este modelo de Estado en períodos pandémicos, llegando a la conclusión que el Estado tiene fundamental importancia para el enfrentamiento social y económico de la crisis instaurada a partir de la diseminación global del covid-19. La metodología utiliza búsqueda bibliográfica, con consultas a libros, artículos científicos nacionales y extranjeros y sitios electrónicos especializados en materias jurídicas, económicas y políticas.O presente artigo busca examinar o papel do Estado Liberal durante períodos de emergência, especialmente diante da crise pandêmica da covid-19, doença causada pelo coronavírus, ou, especificamente, pelo SARS-CoV-2. Nesse contexto, a análise perpassa diversas correntes do pensamento liberal, desde autores libertários que, na linha filosófica de Murray N. Rothbard, afirmam ser o poder estatal improdutivo e imoral, até clássicos que entendem o Estado como ente essencial para a proteção da vida, da liberdade e da propriedade, a exemplo de Frédéric Bastiat, chegando a doutrinadores liberais mais modernos, como Ludwig von Mises, Friedrich Hayek e Milton Friedman, que, mesmo divergindo em relação à intensidade e ao modo da intervenção estatal, desenvolvem seus estudos com foco na imprescindibilidade do Estado em relação aos fins institucionais pelos quais foi criado. Em um segundo momento, conforme as lições de Stephen Holmes e Cass Sunstein, observa-se a necessidade de financiamento público, por intermédio da tributação, para que o Estado Fiscal Liberal atue a fim de garantir os direitos de cariz liberal, mesmo que estes, paradoxalmente, sejam o que parte da doutrina trata como direitos que exigem o dever de abstenção estatal. Ao final, investigam-se as possibilidades de atuação deste modelo de Estado em períodos pandêmicos, concluindo-se que o Estado tem fundamental relevância para o enfrentamento social e econômico da crise instaurada a partir da disseminação global da covid-19.
