The historical school of Law and the Austrian school: The influence of Savigny on Menger, Leoni and Hayek

Resumo: The purpose of this work is to investigate the influence of the Historical School of Law, and more specifically of his most prominent representative, Friedrich Karl von Savigny, on some of the main theorists of the Austrian School of Economy: Carl Menger, Bruno Leoni and Friedrich A. Hayek. Savigny proclaimed the absolute historical character of Law and, therefore, the need that it has to be discovered and apprehended from manifestations of what was called the spiritof the people, rather than created. Despite being ignored in the twentieth century by legal scholars, the Historical School of Law has remained alive in the works of Menger, Leoni and Hayek, who retrieved the teachings of Savigny and the Roman legal tradition and integrated them into their theory of social processes.

Hayek. Savigny proclamaba el carácter histórico del Derecho y, por tanto, la necesidad de que sea descubierto y aprehendido a través de manifestaciones del espíritu del pueblo. A pesar de haber sido olvidada en el siglo XX por los juristas, la Escuela Histórica del Derecho ha permanecido viva en las obras de Menger, Leoni y Hayek, a quienes competió recuperar las enseñanzas de Savigny y la tradición jurídica romana e integrarlas en su teoría de los procesos sociales.Este trabalho analisa a influência da Escola Histórica do Direito, mais especificamente a de seu principal representante, Friedrich Karl von Savigny, no pensamento de alguns dos principais teóricos da Escola Austríaca de Economia, quais sejam: Carl Menger, Bruno Leoni e F. A. Hayek. Savigny proclamava o caráter histórico do Direito, isto é, a ideia de que o Direito haveria de ser descoberto e apreendido mediante manifestações do espírito do povo, em vez de criado por um legislador.
