Resumo: This article aims to present F. A. Hayek's criticisms of Hans Kelsen's legal positivism. Hayekian criticisms refer to the relationship established by Kelsen between law and state and law and justice. For this, Kelsen's conceptions of legal norm and Rule of Law are presented and Hayekian criticisms of Kelsenian pure theory are exposed. The adopted methodology is exploratory through literature review and the research approach is qualitative. It is concluded that, in Hayek's reading, the formalist judgment of the validity of the norm and the identification of the State with the law, as proposed by the positivist Kelsenian model, form a theoretical conception capable of threatening individual freedom because the power of the State becomes unlimited in the production of legal norms.

A. Hayek al positivismo jurídico de Hans Kelsen. Las críticas hayekianas se refieren a la relación establecida por Kelsen entre ley y estado y ley y justicia. Para ello, se presentan las concepciones de Kelsen sobre norma jurídica y Estado de derecho, y luego se exponen las críticas hayekianas a la teoría pura kelseniana. La metodología adoptada es exploratoria a través de la revisión de la literatura y el enfoque de investigación es cualitativo. Se concluye que, en la lectura de Hayek, el juicio formalista de la vigencia de la norma y la identificación del Estado con el derecho, tal como lo propone el modelo positivista kelseniano, configuran una concepción teórica capaz de amenazar la libertad individual porque el poder del Estado se vuelve ilimitado en la producción de normas legales.O presente artigo objetiva apresentar as críticas de F. A. Hayek ao positivismo jurídico de Hans Kelsen. As críticas hayekianas se dão sobre a relação estabelecida por Kelsen entre direito e Estado e direito e justiça. Para isso, apresentam-se as concepções de norma jurídica e Estado de Direito para Kelsen e, em seguida, expõem-se as críticas hayekianas sobre a teoria pura kelseniana. A metodologia adotada é exploratória por meio de revisão bibliográfica e a abordagem da pesquisa é qualitativa.
