THE DEMOCRATIC MANAGEMENT OF PUBLIC SCHOOLS IN CURRENT BRAZILIAN LEGISLATION

Resumo: The “democratic” management of public schools in Brazil was included in the Federal Constitution (CF) in 1988 and reaffirmed by the Law of Directives and Bases in 1996. Therefore, it is in this context that we will discuss concepts and analyze what management is, how it becomes democratic and how this democratic management takes place in Mariana's municipal schools. This is a bibliographic research developed based on official documents related to Brazilian educational public policies. Our objective is to discuss the possibility or not of guaranteeing democratic management as provided for in the current legislation, as well as presenting the proposals for democratic management expressed in Brazilian legal documents, based on reference authors in the area, such as Follet (1997, 2011) , Faro (2003), Libâneo (2008) among others. One of the hypotheses addressed in the project is that the difficulties or impossibilities of guaranteeing the democratic management provided for in the legislation are a discontinuity or non-uniformity on the idea of democratic management in the current legislation until its implementation in the school. After analyzing the official documents of the three spheres of power, the FC, the Law of Directives and Bases of National Education and the Education Plans, we found the existence of variables in public schools that must be combined so that the implementation of democratic management occurs.

Por lo tanto, es en este contexto que discutiremos conceptos y analizaremos qué es la gestión, cómo se vuelve democrática y cómo se lleva a cabo esta gestión democrática en las escuelas municipales de Mariana. Se trata de una investigación bibliográfica desarrollada a partir de documentos oficiales relacionados con las políticas públicas educativas brasileñas. Nuestro objetivo es discutir la posibilidad o no de garantizar la gestión democrática según lo previsto en la legislación vigente, así como presentar las propuestas de gestión democrática expresadas en documentos jurídicos brasileños, basados en autores de referencia en el área, como Follet (1997, 2011), Faro (2003), Libâneo (2008) entre otros. Una de las hipótesis abordadas en el proyecto es que las dificultades o imposibilidades de garantizar la gestión democrática previstas en la legislación son una discontinuidad o no uniformidad sobre la idea de gestión democrática en la legislación vigente hasta su implementación en la escuela. Tras analizar los documentos oficiales de las tres esferas de poder, la CF, la Ley de Directivas y Bases de la Educación Nacional y los Planes de Educación, encontramos la existencia de variables en las escuelas públicas que deben combinarse para que se produzca la implementación de la gestión democrática.A gestão “democrática” da escola pública no Brasil foi incluída na Constituição Federal (CF) em 1988 e reafirmada pela Lei de Diretrizes e Bases em 1996. Portanto, é neste contexto que discutiremos conceitos e analisaremos o que é uma gestão, como ela se torna democrática e de que forma esta gestão democrática acontece nas escolas municipais de Mariana. Esta é uma pesquisa bibliográfica desenvolvida com bases em documentos oficiais relacionados às políticas públicas educacionais brasileiras. Nosso objetivo é discutir sobre a  possibilidade ou não de se garantir uma gestão democrática conforme prevista na legislação vigente, assim como apresentar as propostas de gestão democrática expressas nos documentos legais brasileiros, embasadas em autores referências na area, tal como Follet (1997, 2011), Faro (2003), Libâneo (2008) dentre das hipóteses abordadas no projeto é que as dificuldades ou impossibilidades da garantia da gestão democrática prevista na legislação seja uma descontinuidade ou não uniformidade sobre a ideia de gestão democrática na legislação vigente até a sua implementação na escola.
