Fiscal Decentralization and Municipal Autonomy: elements on debate

Resumo: | The current decentralization process escalating in Brazil since 1980 flanked by the endeavor of the democratization in the country, strengthened the role of the municipality once it was elevated to the status of autonomous federal entity by the Brazilian Federal Constitution of 1988. Upon 25 years of the given new democratic legacy, the municipal revenues increased in volume, in comparison to other spheres, due to the establishment of law and regulations accrediting new responsibilities and new obligations for the municipality. Although it was transformed into politics generator-making agent with potential to promote the local development, by means of power entitlement to be effective as well as the decision towards the design of such politics, the municipality has restricted autonomy towards political decision-making: most part of the resources tend to be transferred to a pre-defined destination via legislation or in the several programs set by the central government. Thus, public expenditures are increasingly as much as to be defined by federal rules as well as financial releases by conditional transfers to sectorial funds, restricted, in practice, to the autonomy of the local expenses. Henceforth, this essay is focused on the contribution to the debate about the possibility of municipal administrations to perform fundamental role of promotions of local development, with greater citizen participation and reduction of social inequalities of which surrounds Brazil, by highlighting elements for the proper analysis of the decentralization process towards the impact of public finance and municipal autonomy. |

En los 25 años del nuevo orden democrático, los ingresos municipales aumentaron en comparación con los de las demás esferas de gobierno, debido a la adopción de leyes y reglamentos que asignan nuevas responsabilidades y crean nuevas obligaciones para el municipio. Aunque se haya transformado en agente ejecutor de políticas públicas con el potencial de promover el desarrollo local, en cuanto a la capacidad efectiva de decisión del diseño de estas políticas, la autonomía es restricta: los recursos transferidos tienen destinación predefinida en leyes o en los varios programas establecidos por el gobierno central. Los gastos, por lo tanto, se están definiendo crecientemente por las reglas federales y financiados con recursos vinculados a fondos sectoriales, lo que limita, en la práctica, la autonomía del gasto local. El trabajo contribuye al debate sobre la posibilidad de que las administraciones municipales desempeñen el papel fundamental de promotores del desarrollo local, con una mayor participación de los ciudadanos y la reducción de las desigualdades sociales que caracterizan a Brasil, destacando elementos para el análisis de los impactos de los procesos de descentralización sobre las finanzas públicas y la autonomía municipal.O avanço do processo de descentralização em curso no Brasil desde os anos de 1980, que acompanhou o movimento de redemocratização no país, fortaleceu o papel do município, elevado pela Constituição de 1988 ao status de ente federativo autônomo. Nos 25 anos de vigência da nova ordem democrática, as receitas municipais aumentaram em volume e comparativamente às demais esferas, em decorrência da aprovação de leis e normas que atribuíram novas responsabilidades e criaram novas obrigações para o município. Ainda que transformado em agente executor de políticas públicas com potencial para promover o desenvolvimento local, em termos de efetivo poder de escolha e decisão do desenho dessas mesmas políticas, o município tem autonomia restrita à execução: a maior parte dos recursos transferidos tem destinação pré-definida na legislação ou nos diversos programas definidos pelo governo central. As despesas, por conseguinte, foram sendo crescentemente delimitadas pelas regras federais e financiadas com as transferências vinculadas aos fundos setoriais, limitando na prática a autonomia de gasto local.
