The present work aims to verify the need to adopt alternative measures to female incarceration in Brazil, especially the possibility of applying house arrest as a substitute for pretrial detention for mothers and pregnant women arrested. For this, the recent decision of the Supreme Federal Court in Habeas Corpus Coletivo 143641/SP, its foundations, guidelines, effects and reflexes, will be analyzed. The methods used were the deductive that consisted of bibliographic analysis on the subject and, sequentially, under the inductive method the research appreciated hc 143641/SP. It was stated, at the end, that although it is a decision to be applied throughout the national territory, the lower instances still position themselves in a divergent way, performing different interpretations about the benefit, with resistance to its application.
