Having in mind the legislative reforms of the actuality, a debate was raised about the role of the elderly in the labor market, the arguments for professional working life and professional experience follow the analysis of quality conjunctures working conditions and perspectives of respect for the special conditions of elderly employees. The constitutional super-principle of the dignity of the human person of material equality and respect for the individualities of the older person were raised. The unfavorable conditions that this minority encounters in active life are put to analyze, such as discrimination given its ageing nature. As a solution, public programs are presented to absorb this workforce, as well as initiatives of private companies. The study of real cases of popular revolt in a situation of containment of fundamental rights in the international scenario also contributed to the understanding of the Brazilian context. Finally, the benefits of an elderly employee sum in a company are considered, pointing to an increase in income stemming from the greater experience this group upholds, taking as evidence interviews with representatives of both sides and survey of real cases.
