THE IMPACTS OF VIDEO GAMES AS "INCITERS" OF CRIME

Resumo: There is a repeated debate in society that virtual games can influence violent behavior, this leading into the commission of crimes. The objective of this article seeks to demonstrate that this premise is often embedded with moral convictions and at the service of sensationalist media, generating an unnecessary moral panic around video games. This has consequences on the perspective of the law, where through the analysis of bills and prohibitionist judicial decisions it will be demonstrated how the war against games generates offense to the fundamental right of freedom of expression. Still through scientific research, arguments that demystify the supposed cause and effect relationship between video games and violence will be addressed. Finally, the main benefits that the use of electronic games can bring will be presented, as well as a guide for parents in order to facilitate the choice of which ones would be more suitable for their children and how to use them. Therefore, the following methodology was used: deductive and dialectical approach; historical and statistical procedure method; and the technique of bibliographic research. In conclusion, games are a useful tool for society and do not deserve to be criminalized.

In conclusion, games are a useful tool for society and do not deserve to be criminalized.Há uma discussão reiterada na sociedade de que os jogos virtuais podem influenciar em possíveis comportamentos violentos, levando assim ao cometimento de crimes. O objetivo desse artigo busca demonstrar que essa premissa muitas vezes está embutida com convicções morais e a serviço da mídia sensacionalista, gerando um pânico moral desnecessário em torno dos videogames. Isso gera consequências sobre a perspectiva do direito, onde pela análise de projetos de lei e decisões judiciais proibicionistas será demonstrado como a guerra contra os jogos gera ofensa ao direito fundamental das liberdades de expressão e artística. Ainda por meio de pesquisas cientificas serão abordados argumentos que desmitificam a suposta relação de causa e efeito entre videogames e violência. E por fim serão apresentados os principais benefícios que o uso dos jogos eletrônicos pode trazer, além de um guia para os pais com o objetivo de facilitar a escolha de quais deles seriam mais adequados a seus filhos e como utiliza-los. Para tanto, utilizou-se da seguinte metodologia: abordagem dedutiva e dialética; método de procedimento histórico e estatístico; e a técnica de pesquisa bibliográfica.
