THE BRAZILIAN PRISON SYSTEM: contextualizing the normative scenario and its effectiveness

Resumo: The work aims to analyze the conditions of incarceration especially after the declaration, by the Supreme Court, of the State of Unconstitutional Things in Brazilian prisons. In addition, it seeks to set out certain measures implemented in an attempt to improve existing conditions, as well as other possible ones that could be undertaken. The methodology used is the bibliographic review and the collection of data provided by secondary sources to support the proposed theme. It is concluded that, despite efforts by certain bodies, a structural change is needed regarding the prison system, including dignity as an inherent value of every human being, it is the duty of the State to ensure the protection of the rights of persons deprived of liberty and to adopt measures to alleviate existing prison overcrowding.

Além disso, busca expor determinadas medidas implementadas na tentativa de melhorar as condições existentes, bem como outras possíveis que poderiam ser empreendidas. A metodologia utilizada é a revisão bibliográfica e a coleta de dados fornecidos por fontes secundárias para dar embasamento à temática proposta.
