SEARCHING COUNTER-HEGEMONIC PERSPECTIVES OF HUMAN RIGHTS : an analysis of the LGBTFOBIA’s criminalization by the Supreme Court and the impacts of the brazilian's system of precedents in the fundamental rights’s recognition

Resumo: This article aims to propose the revisiting of Human Rights narratives as currently conceived by the International Law of Human Rights to explore new possibilities for social grammars that value the multiculturalism and don’t  silence or exclude subjectivities of vulnerable groups in the name of the utopic pretension of universality that consolidates the inequality of hegemonic narratives of power from neoliberal, eurocentric and patriarchal capitalism. To this end, the Supreme Court's decision in the constitutional review that criminalized LGBTFOBIA is used as paradigm to support the urgent discussion on the importance of the binding and social effectiveness of the brazilian’s system of precedents, emphasizing its reflections on search for the recognition of fundamental rights and the promotion of new juridical and social grammars able to effect the representation and occupation of democratic spaces of power within a multicultural and pluridiverse society.
