BRAZIL AND ITALY: A COMPARISON BETWEEN THE COMPOSITIONAL MODELS OF THE CONSTITUTIONAL COURTS

Resumo: The STF compositional model is analyzed compared to the Italian Constitutional Court, in order to verify the following matter: what is the level of democratic motivation in the minister's designation? The hypothesis was considered: The democratic efficiency in STF's compositional process is debated. Tracing a parallel between Brazilian and Italian Courts is the general purpose. The specific objectives are: to outline the constitutional Courts in broad angle; to detail STF's internal structure, and to differ it from the Italian Court. This paper is relevant to the law agent, due to possibility of have an effect in the law institutions' efficiency; for legal sciences it is relevant due to STF's decisiveness nature; it is also relevant to the society given that the popular participation in these matters legitimizes the Federal Supreme Court. This paper is a theoretical qualitative research.

This paper is a theoretical qualitative research.Analisa-se o modelo compositivo do STF contraposto à Corte Constitucional Italiana para examinar o seguinte problema: qual o grau de estí­mulo democrático na indicação dos ministros? Cogitou-se a hipótese: discute-se a eficácia democrática do processo compositivo do STF. O objetivo geral é analisar a estrutura do STF, paralelamente à Corte Italiana. Os objetivos especí­ficos são: delinear os Tribunais Constitucionais em sentido amplo; minuciar o STF; diferir este da Corte Italiana. Este trabalho é importante para o operador do Direito devido à possibilidade de sopesar a eficiência das instituições jurí­dicas; para a ciência jurí­dica, é relevante pela natureza finalí­stica do STF; agrega à sociedade pelo fato da participação popular em tais assuntos reforçar a legitimidade do STF.
