Resumo: Unfaithful receiver's concept will be seen and made an analysis of the constitutional forecasts about the possibility of the unfaithful receiver's prison. Soon afterwards, they will be mentioned the international treaties that they regulated the theme, in other words, the American Convention of Human Rights, known as the Pact of São José of Costa Rica, as well as the International Pact of the Civil laws and Politi- cal. Since then, it will be made a study of the doctrine on the theme and an analysis of the jurisprudence of Federal Supreme court to the year 2008, when there was the Constitutional Mutation of the Brazilian Supreme Cut on this theme.\

Em seguida, serão citados os tratados internacionais que regularam o tema, ou seja, a Convenção Americana de Direitos Humanos, conhecida como o Pacto de São José da Costa Rica, bem como o Pacto Internacional dos Direitos Civis e Polí­ticos.
