AUTONOMY OF WILL IN THE PRIVATE INTERNATIONAL RELATIONS THAT RULE ON THE ARBITRATION LEGAL PROCESS

Resumo: The principle of autonomy of will is not recent. In the history of law, specially in the Roman law it shed light on the subject and demonstrates that it was already part of that distant reality in the contemporary world. However, given the particularities of the modern State and the reality consolidated through the economic Liberalism, the autonomy of will gained new hues given the context where social and economic relations expanded beyond national borders. The article presents a perspective of the globalized reality in which the autonomy of will reappears in the subfields of Private Law, especially the International Private Law, embracing the transnational law as an arbitration legal process.

Contudo, dadas as peculiaridades do Estado atual e da realidade que se consolidou com o Liberalismo econômico, a autonomia da vontade ganhou novos matizes porque inserida num contexto ligado às relações sociais e econômicas que romperam as fronteiras nacionais.  É sob a perspectiva dessa realidade globalizada que a autonomia da vontade aparecerá nos subcampos do Direito Privado, em especial do Direito Internacional Privado, abrangendo o direito transnacional como processo jurídico da arbitragem.
