Arbitration as a Dispute Settlement Mechanism Involving Legal Relations of Heritage Character

Resumo: The commercial arbitration has been consolidated as one of the preferred methods for settling disputes, especially in the contract case. Disputes over international contracts are typically resolved through arbitration, as individuals prefer a body that acts quickly, secret, and usually held by private institutions also dedicated in the area. The arbitrators are chosen by the parties and, in general, have remarkable experience in the questions under the trial. The arbitration award is required and can be enforced in the same manner as the court ruling. As Brazil finally promulgated the New York Convention of 1958 on the Recognition and Enforcement of Foreign Arbitration Awards Reports, it is part of the country, increasing in the vast chain of international trade.

Litigios sobre contratos internacionales ya son tradicionalmente resueltos por medio del arbitraje, pues los particulares prefieren una instancia que actúe de forma rápida, de forma sigilosa, y, normalmente, realizada por instituciones también privadas que se dedican a la materia. Los árbitros son elegidos por las partes, y, generalmente, tienen notable experiencia en las cuestiones sometidas a juzgamiento. La sentencia arbitral tiene fuerza obligatoria, pudiendo ser ejecutada en los mismos moldes de la sentencia judicial. Tras la promulgación de la Convención de Nueva York de 1958 por Brasil sobre el Reconocimiento y la Ejecución de Laudos Arbitrales Extranjeros, se inserta el País, de forma cada vez más sólida, en la vasta corriente del comercio internacional.A arbitragem comercial tem-se consolidado como um dos métodos preferenciais para a resolução de litígios, especialmente, no caso dos contratos. Litígios sobre contratos internacionais já são tradicionalmente resolvidos por meio de arbitragem, pois os particulares preferem uma instância que atue de forma rápida, de modo sigiloso e, em regra, realizada por instituições também privadas que se dedicam à matéria. Os árbitros são escolhidos pelas partes e, em geral, têm notável experiência nas questões submetidas a seu julgamento. A sentença arbitral tem força obrigatória, podendo ser executada nos mesmos moldes da sentença judicial.
