Resumo: Abstract: This article aims to analyse the historical and political conditions that have turned the family and community coexistence into a juridical-political object of the Brazilian State. The research was inspired by Michel Foucault’s theoretical-methodological tools. The study analyses national and international historical documents, produced during the 20th and the 21st centuries, concerning rights and policies for children and teenagers. The results signal that the production of law is marked by racist, colonial and philanthropic practices, incarceration, socio-familiar centralization and the adoption of universal speeches as strategies for governing in different historical periods. The conclusions point out the need to analyse critically the speeches and practices that forged such law, in order to denaturalize it and to reflect on the possible ethical-political effects of its drives and justifications on the public policies and contemporary daily actions.

A pesquisa foi inspirada por ferramentas teórico-metodológicas de Michel Foucault. O estudo analisa documentos históricos nacionais e internacionais, produzidos durante os séculos XX e XXI, sobre os direitos e políticas para crianças e adolescentes. Os resultados sinalizam que a produção do direito é marcada por práticas racistas, coloniais, filantrópicas, encarceramento, centralização sociofamiliar e adoção de discursos universais como estratégias de governar em diferentes períodos históricos.
