The perspective of the hermeneutic method on the interpretation of the religious freedom right and the constitutional principle of human dignity

Resumo: The proposal of the article has as a goal analyse the influence of the hermeneutic method in the interpretation of the constitucional text about religious freedom and the principle of human dignity, as well as human rights.  It's put into question: how the hermeneutic method can contribute in the interpretation of religious freedom right in front of the violations edured, even it being precept in the brazilian Constitution? To address this goal it's necessary to resort to the theoretical contributions specific to the theme, in order to substantiate the raised arguments. It was used bibliographic and qualitative descriptive research, since the proposal discusses the theme from a selected corpus. This corpus does not exhaust the problem, but throws light about the secured right of religious freedom, being target of interdisciplinary reflection between the theological-legal areas. Concludes the Democratic State favors the assecuratory action of the freedom right, therefore being unreasonable the non-observance of a constitutional right present in society.

Questiona-se: como o método hermenêutico pode contribuir na interpretação do direito sobre liberdade religiosa, diante das violações sofridas, mesmo sendo ele preceituado na Constituição brasileira? Para tratar desse objeto é preciso recorrer aos aportes teóricos específicos ao tema, a fim de fundamentar os argumentos levantados. Faz-se uso da pesquisa bibliográfica e descritiva de natureza qualitativa, visto que a proposta discute a temática, a partir de um corpus selecionado. Esse corpus não esgota a problemática, mas lança luzes acerca do direito assegurado quanto à liberdade religiosa, sendo alvo de reflexão interdisciplinar entre as áreas teológico-jurídica.
