Disability and mobility: an analysis of brazilian legislation concerning free public transport

Resumo: This article provides an overview of Brazilian national legislation regulating discounts and free public transport for people with disabilities. The goal is to analyze how transport policies guarantee the right to mobility of the urban poor in Brazil. The right to mobility is a human capacity that guarantees a dignified life. Disability is not in the body, but on moral and urban barriers of a society that is unable to meet the body diversity of people. We surveyed the local laws in force in 27 Brazilian capitals and the federal legislation related to transport and mobility of persons with disabilities. The data analysis identified that: 1. there is uncertainty about who the people with disabilities are; 2. there are several levels of recognition of the dependence of public transport users' disability; 3. the cutting conditions on household income limits the right to free public transport. These results reveal that there is a restriction on the right to mobility, since transport is not considered a tool to ensure social equality yet. Key-words – Disability. Urban mobility. Transport. Public policies. Social justice.Este artigo apresenta o panorama legislativo nacional que regulamenta descontos e gratuidades no transporte coletivo para pessoas com deficiência. O objetivo é analisar como as políticas de transporte garantem o direito à mobilidade urbana dos deficientes no Brasil. O direito à mobilidade é uma capacidade humana que assegura a vida digna. As desvantagens pela deficiência não estão no corpo, mas nas barreiras morais e urbanas às pessoas com impedimentos corporais. Foram pesquisadas as legislações municipais vigentes em 2009 nas 27 capitais brasileiras e a legislação federal relacionada com o transporte e a mobilidade das pessoas com deficiência. Com base na análise dos dados, foi possível identificar que: 1. há indefinição sobre quem são as pessoas com deficiência para fins de proteção pela política de transporte; 2. há vários níveis de reconhecimento da dependência a partir da deficiência dos usuários de transporte público; 3. o recorte de renda familiar para ter direito a descontos ou gratuidade condiciona e limita o direito à gratuidade. A partir desses resultados, conclui-se que há restrição do direito à mobilidade, visto que o transporte ainda não é considerado um instrumento para garantir a igualdade. Palavras-chave – Deficiência.
