Moral harassment in employment relations: the case of a teacher at a private higher education institution

Resumo: It aimed to describe and analyze court decisions related to a judicial process referring to the occurrence of psychological harassment suffered by a professor at a private higher education institution. Descriptive research with a qualitative approach, through a case study where data were analyzed using the content analysis technique. The results showed the victim’s difficulty in proving the harassment before the judiciary, which adopted a different understanding regarding the assessment of evidence to prove its characterization, causing the damage to not be repaired and the harasser not punished, leaving the victim even more impotent facing the situation experienced.

Investigación descriptiva con enfoque cualitativo, a través de un estudio de caso donde los datos fueron analizados mediante la técnica de análisis de contenido. Los resultados evidenciaron la dificultad de la víctima para acreditar el acoso ante el Poder Judicial, que adoptó un entendimiento diferente en cuanto a la valoración de la prueba para acreditar su caracterización, provocando que el daño no sea reparado y el acosador no sancionado, dejando a la víctima aún más impotente ante la situación experimentada.Objetivou descrever e analisar decisões judiciais relativas a um processo judicial referente à ocorrência de assédio moral sofrido por docente de uma instituição privada de ensino superior. Pesquisa descritiva de abordagem qualitativa, por meio de estudo de caso onde os dados foram analisados pela técnica de análise de conteúdo.
