Resumo: | Within the existing constitutional theory, it is necessary to review the phenomenon that emerged at the end of the 20th century and the beginning of the 21st century in Latin America. This trend has been called New Latin American Constitutionalism (NCL), which encompasses reforms or new constitutions starting from the Brazilian one in 1988 to the expected Chilean one. There are some controversies, vicissitudes, and meeting points within the constitutional doctrine, that is why this study tries to explain the NCL; determine your three big problems; the relationship it has with the "engine room" of the Latin American constitutions. Determine its material and formal characteristics. And to conclude that bridges need to be created where theory is materialized in practice with constitutional postulates that are transformative, innovative and that make the rights of people effective. |

Esta corriente ha sido denominada Nuevo Constitucionalismo Latinoamericano (NCL), a partir de la cual las reformas incluyen las nuevas constituciones partiendo de la brasileña de 1988 hasta la esperada chilena. Dentro de la doctrina constitucional existen algunas controversias, vicisitudes y puntos de encuentro, por lo que este estudio intenta explicar la NCL; determinar sus tres problemas principales; la relación que tiene la “sala de máquinas” de las constituciones latinoamericanas.
