Female participation in politics in Brazil and the challenges towards participatory parity democracy

Resumo: Women are most of the Brazilian electorate able to vote and yet are abysmally underrepresented in public spaces of power, both in elective positions of political representation, as in the internal compositions of institutions, from political parties to the courts. Present at the bases and absent from positions of influence and leadership, they not only face the historical political, economic and social inequalities that have kept them for so long excluded from the enjoyment of formal equality of rights in relation to men, but they are also victims of discrimination and gender-based violence, which are aggravated at the same intensity with which they aim for positions of greater prominence in public life. Positioning the Brazilian reality in a world context of millenary male domination and the historical struggle of women for political rights and substantive equality, this study seeks in political science the origins of female exclusion from the foundation of modern democracy, as well as the theoretical justifications for the implementation of temporary affirmative measures to repair such inequalities. Analyzing the gender quota legislation for the inclusion of women in the parliament and the extremely relevant contributions of new affirmative policies built through the jurisprudence of the Superior Courts, in comparison with the human rights treaties signed by Brazil, in the face of persistent resistance from political parties and Brazilian parliament itself in advancing this agenda, this study seeks to design a new model that contemplates the implementation of gender parity in other institutions, together with the strengthening of popular participation mechanisms provided for in the Constitution, which are now practically obsolete. It is, finally, a project of participatory parity democracy.

Presentes en la base y ausentes de los puestos de influencia y liderazgo, no solo enfrentan históricas desigualdades políticas, económicas y sociales que las han mantenido excluidas durante tanto tiempo del disfrute formal de la igualdad de derechos con los hombres, sino que también son víctimas de discriminación y género. violencia de base, que se agrava en la misma intensidad con la que buscan posiciones de mayor protagonismo en la vida pública. Situando la realidad brasileña en un contexto mundial de antigua dominación masculina y de lucha histórica de las mujeres por los derechos políticos y la igualdad sustantiva, este estudio busca en la ciencia política los orígenes de la exclusión femenina en la base de la democracia moderna, así como las justificaciones teóricas para la implementación de medidas afirmativas temporales para remediar tales desigualdades. Analizando la legislación de cuotas de género para la inclusión de la mujer en el Poder Legislativo y los aportes muy relevantes de las nuevas políticas afirmativas construidas a través de la jurisprudencia de los Tribunales Superiores, en comparación con los tratados de derechos humanos suscritos por Brasil, ante la insistente resistencia de los partidos políticos y del propio Poder Legislativo para avanzar en esta agenda, se intenta diseñar un nuevo modelo que incluya la implementación de la paridad de género en otras instituciones, aunado al fortalecimiento de los mecanismos de participación popular previstos en la Constitución, que en la actualidad se encuentran prácticamente obsoletos. Es, después de todo, un proyecto de democracia paritaria participativa.As mulheres são a maioria do eleitorado brasileiro apto a votar e ainda assim estão abissalmente sub-representadas nos espaços públicos de poder, tanto nos cargos eletivos de representação política, como nas composições internas das instituições, dos partidos políticos aos tribunais. Presentes nas bases e ausentes dos postos de influência e liderança, elas não enfrentam apenas as desigualdades políticas, econômicas e sociais históricas que as mantiveram por tanto tempo alijadas do gozo de igualdade formal de direitos com relação aos homens, mas também são vítimas de discriminações e violências em razão de gênero, que se agravam na mesma intensidade com que elas almejam posições de maior protagonismo na vida pública. Posicionando a realidade brasileira em um contexto mundial de milenar dominação masculina e da luta histórica das mulheres por direitos políticos e igualdade substantiva, o presente estudo busca na ciência política as origens da exclusão feminina da fundação da democracia moderna, assim como as justificativas teóricas para a implementação de medidas afirmativas temporárias que reparem tais desigualdades. Analisando a legislação de cotas de gênero para inclusão de mulheres no Poder Legislativo e as contribuições relevantíssimas de novas políticas afirmativas construídas via jurisprudência das Cortes Superiores, em comparação com os tratados de direitos humanos aderidos pelo Brasil, diante da insistente resistência dos partidos políticos e do próprio Poder Legislativo em avançar nessa pauta, busca-se desenhar um novo modelo que contemple a implementação da paridade de gênero nas demais instituições, aliado à potencialização dos mecanismos de participação popular previstos na Constituição, hoje praticamente obsoletos.
