Resumo: This PhD thesis is part of the line of research on the effectiveness of Private Law and Civil Liberties, in the nucleus of Comparative Civil Law research, and begins by traversing the historical periods from Pre-Modernity to Post-Modernity, highlighting the main Socioeconomic characteristics with a focus on the philosophical thought present in each moment. Societies have their genesis in the formation of the family structure analyzed from its spontaneous emergence to contemporaneity. The social, political, economic, technological and biotechnological revolutions influenced by the rational thought of Modernity were responsible for the different awakening of humanity that faces new paradigms increasingly focused on the centrality of man. The legislation seeks to follow the rapid changes experienced by the family institute which, after the promulgation of the Constitution of 1988, presented new contours, with emphasis on the affectivity, which jurists intend to label as a legal principle. The rational paradigms erected during Modernity are being deconstructed by the postmodern relativist philosophy, defender of the absence of truth and human nature. In the midst of the changes in course, it is essential to adopt a critical stance, with the revisiting of concepts, mainly by law professionals such as judges and notaries, to avoid a social and legal reengineering through the obscure gender ideology

Inicia-se percorrendo os períodos históricos, desde a Pré-Modernidade até a Pós-Modernidade, evidenciando as principais características socioeconômicas com enfoque para o pensamento filosófico presente em cada momento. As sociedades têm sua gênese na formação da estrutura familiar analisada a partir de seu surgimento espontâneo até a contemporaneidade. As revoluções sociais, políticas, econômicas, tecnológicas e biotecnológicas, influenciadas pelo pensamento racional da Modernidade, foram responsáveis por diferentes despertares da humanidade, que se depara com paradigmas inéditos, cada vez mais voltados para a centralidade do homem. A legislação procura acompanhar as rápidas evoluções experimentadas pelo instituto familiar que, após a promulgação da Carta Magna de 1988, apresentou novos contornos, com destaque para a afetividade, que doutrinadores intentam rotular como princípio jurídico. Os paradigmas racionais erigidos durante a Modernidade, estão sendo desconstruídos pela filosofia pós-moderna relativista, defensora da ausência de verdade e da natureza humana.
