A crise do risco social como objeto de proteção do seguro social: análise do modelo de seguro social no Regime Geral de Previdência Social

Resumo: Social risk is the element commonly elected as the object of social insurance protection and acts as a reference of model structure. However, when analyzing the parts of this instrument in the General Social Insurance System, it is possible to see distortions in the role played in certain social insurance situations, which raises questions about its indispensability and impacts on the functioning of social insurance. Thus, using a qualitative approach with bibliographic research, the (in)dispensability of social risk as an object of social insurance protection and the consequences of its flexibility in protective relations was investigated. To achieve the objective, it was necessary to analyze the historical construction that resulted in the creation of social insurance, pointing out the diferences in the elements of private insurance that resulted in the structural design of social insurance. It was investigated the social security situations of the General Social Insurance System that make social risk as the main element more flexible and impact the contributory security structure, the social need and its own concept.. The situations presented revealed impacts that weaken social insurance and affect the Social Insurance System. Thus, it was found that the strengthening of Social Security is a fundamental measure to consolidate social insurance and allow the sustainability of the protection model and effectiveness in face of the risk society

No entanto, quando se analisam as engrenagens desse instrumento no Regime Geral de Previdência Social, é possível verificar distorções quanto ao papel desempenhado em certas situações previdenciárias o que levanta questionamentos sobre a sua imprescindibilidade e os impactos no funcionamento da previdência social. Com isso, utilizando uma abordagem qualitativa, com a realização de pesquisas bibliográficas, buscou-se investigar a (in)dispensabilidade do risco social como objeto de proteção do seguro social e os reflexos da sua flexibilização nas relações protetivas. Para alcançar o objetivo, foi preciso analisar a construção histórica que resultou na criação do seguro social, diferenciando os elementos do seguro privado que resultaram no desenho estrutural do seguro social. Investigaram-se as situações previdenciárias do Regime Geral de Previdência Social que flexibilizam o risco social como elemento principal e reverberam a estrutura securitária no que diz respeito à contributividade, ao estado de necessidade e ao seu próprio conceito. As situações apresentadas revelaram impactos que fragilizam o seguro social e repercutem no sistema de Seguridade Social.
