With the advanced growth of Shopping Centers in the national territory, are emerging new situations of conflict, and, consequently, the necessity of the right to sustain all situations and to respond to citizens on the occurrence experienced. Based on this situation, this work has for objective to describe some situations that should be observed in formalizing contracts of Shopping Center, while highlighting the problems that can arise in such a relation, which may lead to the failure of the joint venture and calculation of responsibilities. The analysis of the studies presented by militants in the area, and judged judgments delivered in national territory, highlighted some routine situations in Shopping Centers, showing some actions that may be claimed in the phases pre-ins in the execution of the contract and at the time of termination, with the joint application of legal diplomas, compared to the lack of specific legislation to encompass the theme
