The goal of this paper is to analyze the history of the Standardization of the Jurisprudence Incident, observing its development and closing with a critical analysis in accordance with the last modification of the Law 13.015/2014. Initially, the strategy used is to analyze the development of the number of processes which enter the Judiciary daily and is introducing chaos into the system. Such changes underscore the necessity of the legislative system to present new solutions to the ever increasing number of processes. The Incident of the Standardization of the Jurisprudence, which can trace ts roots back to the 1939 Code of Civil Procedure, uses a different name, but contains the same basic g0als.we wll be analyzing the history and development of the Institute up to the present date, which introduces modifications, emphasizing the real utilization of the lncident, and consequently includes the Standardization of the Jurisprudence of the Regional Labor Courts.Lastly, in analyzing the modifications made by the Law 13.015/2014, a critique is made due to oopholes in the legisation. we hereby demonstrate our critical opinion, defending that such a position cannot be assigned to the Superior Labor Court, once this legislation at any moment describes this understanding, bringing in certain considerations based on what we believe to be the best way to proceed.
