Resumo: The presents work study about special contest of creditors against debtor solvent under articles 711 and following of the Code of Civil Process, in particulars the occasional contradictions between the civil process law to labor law and tax law. The relevance of this work is evident in that it seeks to clarify the order of preference of credits, with the analysis of legitimacy and legal appeal to be promoted. The study aim to fill the gaps left by civil legislation that brings legal insecurity and uncertainty in the judicial pronouncement, seek primarily to answer in jurisprudence of Superior Court of Justice and native doctrine
